Hayley Shallard

This afternoon, I am tasked with drafting a statutory declaration in support of the registration of our client's trade mark on the basis that it has been used by our client for over 20 years, during which time it has acquired distinctive character and is well-recognised as a trade mark in the marketplace.

7.00 AM

Monday morning. I wake up to the obnoxious noise that is my alarm and quickly grab my phone and hit snooze. Saturday was the Buddle Findlay ball which was so much fun. The memory of the chocolate table gets me up out of bed – fingers crossed there will be some leftover macaroons in the Hub today!

8.30 AM

I arrive at the office and make my first coffee of the day in the hub. I fire off a few emails and check my Outlook calendar to see what's on for the week.

Next on the agenda is an IP/TMT meeting, a regular Monday morning occurrence where we catch up about our weekends and discuss our workloads for the week.

9.30 AM

IPONZ has issued a compliance report for a trade mark application that we filed for a client. After chatting with Sophie, I prepare a reporting email to the client outlining the objections together with our recommendations.

11.00 AM

We head down to our regular café for a team coffee break and I order a caramel latte.

11.30 AM

I fire off some more emails then get started on my next task which is conducting some IPONZ and online marketplace searches so that we can ascertain the legal risk for our client using and/or registering their proposed trade mark.

12.15 PM

I sit in with Hamish on a call with a client in which he provides some preliminary advice and gathers instructions.

1.00 PM

It's lunchtime!  Buddle Findlay is in the HSBC building which is right beside commercial bay, so Jayna and I head over to get loaded wedges.

I come back to my desk and I have a parcel!  It's my completion certificate from the New Zealand Council of Legal Education.  I prepare my court documents including an affidavit in support, a sealing order, exhibit labels and a moving counsel originating application which I will need to file in the High Court for my October admission.

This afternoon, I am tasked with drafting a statutory declaration in support of the registration of our client's trade mark on the basis that it has been used by our client for over 20 years, during which time it has acquired distinctive character and is well-recognised as a trade mark in the marketplace.  Incorporating all of the evidence of use that has been provided to us by our client into the statutory declaration will take a while, so I put my head down and get to work!

5.20 PM

Home time! I pack up my things and head to the train station. My train arrives at Orakei just in time to see the sunset.
